3. Initial consultations
Sending an enquiry or booking an initial consultation does not create any obligation to buy tuition.
The consultation is used to understand the student's requirements and decide whether Tutor York can provide appropriate support.
A contract for paid tuition is formed when the parent, guardian or adult student agrees the proposed tuition arrangements and Tutor York confirms the booking.
4. Parents, guardians and students under 18
Where a student is under 18, the person booking tuition must normally be the student's parent or legal guardian, or another adult authorised to make the booking. The adult making the booking is responsible for:
- providing accurate information
- agreeing tuition arrangements
- making payments
- telling Tutor York about relevant changes
- making appropriate arrangements for the student's attendance
5. Fees
Tuition fees will be confirmed before tuition begins. Fees may vary depending on:
- the level of tuition
- the type of support
- session length
- whether tuition is online or in person
- specialist university admissions support
No one will be committed to paid tuition without first being told the fee.
6. Payment
Payment arrangements will be confirmed before tuition begins.
Invoices or payment requests must be paid by the due date stated.
If payments remain overdue, Tutor York may pause future lessons until the outstanding balance is paid.
This does not affect your statutory rights.
7. Statutory cancellation rights
If you enter into a contract for Tutor York's services online, by email, by telephone or otherwise at a distance, you may have a statutory right to cancel it within 14 days of entering into it.
To cancel, email enquiries.tutoryork@gmail.com. A clear statement that you wish to cancel is enough.
Starting tuition within the 14-day cancellation period
If you would like tuition to start within the 14-day cancellation period, we will ask you to confirm this request in writing (email is fine) before the first lesson.
If you then cancel after tuition has started, you may have to pay a proportionate amount for the lessons already provided, where the law allows. Where a service has been fully provided after you asked for it to start and acknowledged this, the right to cancel that completed service may no longer apply.
8. Lesson cancellations and rescheduling
This section covers cancelling individual lessons. It is separate from your statutory cancellation rights.
- You can cancel or rearrange a lesson without charge if you give the notice agreed when you book.
- If you give less notice than this, Tutor York may charge some or all of the agreed lesson fee.
- Tutor York may waive a cancellation charge in exceptional circumstances.
- This policy will always be applied reasonably and fairly.
9. Tutor cancellations
If Tutor York needs to cancel a lesson, we will make reasonable efforts to arrange an alternative session.
If a suitable replacement cannot be agreed, you will not be charged for the cancelled lesson, or you will receive a refund or credit if you have already paid.
10. Late arrival
If a student arrives late, Tutor York may not be able to extend the lesson beyond the agreed finishing time. We will make reasonable efforts to provide the remaining lesson time.
11. Online lessons
You are responsible for making sure the student has:
- a suitable device
- a reliable internet connection
- any required software or browser access
- a suitable environment for the lesson
If a lesson cannot reasonably go ahead because of a technical problem within Tutor York's control, the lesson will be rearranged or credited.
Tutor York is not responsible for temporary failures of third-party internet, video-conferencing or communications services outside its reasonable control.
12. Educational outcomes
Tutor York will provide its services with reasonable care and skill.
Academic outcomes depend on many factors outside Tutor York's control, including attendance, independent study, school teaching, coursework, exam performance and exam board decisions. Tutor York therefore cannot guarantee a particular:
- grade
- exam result
- university offer
- interview outcome
- admissions test score
Nothing in these terms removes your statutory rights.
13. Student conduct
Students are expected to behave appropriately during lessons.
Tutor York may end or suspend tuition where behaviour makes it unreasonable or unsafe to continue.
Where appropriate, concerns about a student under 18 will be discussed with their parent or guardian.
14. Teaching materials
Teaching materials supplied by Tutor York are for the student's personal educational use. Unless we say otherwise in writing, materials must not be sold, published, uploaded publicly, reproduced commercially or shared with third parties.
Third-party materials, such as exam papers, remain subject to the rights of their owners.
15. Recording lessons
Neither party may record a lesson without the other's agreement.
Where the student is under 18, a parent or guardian must give permission before any recording takes place.
16. Ending an ongoing tuition arrangement
Either Tutor York or you may end an ongoing tuition arrangement. You remain responsible for:
- tuition already provided
- any outstanding invoices
- any fair and valid late-cancellation charges already incurred
Tutor York may stop providing tuition where there are reasonable grounds to do so, including persistent non-payment or serious conduct concerns.
17. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so. In particular, nothing excludes the rights and remedies available to consumers under consumer law.
Tutor York is not responsible for losses that could not reasonably have been foreseen when the contract was formed.
18. Privacy
Personal information is handled in line with the Tutor York Privacy Policy.
19. Complaints
If you are unhappy with Tutor York's service, email enquiries.tutoryork@gmail.com. We will look into your concerns reasonably and respond appropriately.
20. Changes to these terms
Tutor York may update these terms from time to time. Changes will not take away rights already agreed with existing customers without their agreement where that agreement is required. The latest version is always published on this website.
21. Governing law
These terms are governed by the laws of England and Wales. Consumers keep any rights they have about where legal proceedings may be brought under consumer law.
